Terms of Service for ART Comission

Hey there! Before we get started, I'll need you to check out these guidelines so there isn't any trouble! Alright, let's start with the dos and don'ts:

FOR PERSONAL ART (digital paintings, character illustrations, fan art, etc.):
The client may:
• Print your commission for personal use only;
• Repost your commission on your personal social media page (posts focused on the art itself), with proper crediting;
• Use the artwork on up to 5 physical products (t-shirts, mugs, phone cases, etc.) for personal use only — not for resale, with the EXCEPTION stickers can be printed and sold freely, with no rules or extra fees;
• Have lots of fun with their new awesome artwork!
The client may not:
• Get their artwork made before payment;
• Repost art post, without crediting (making sure that my watermark signature is visible is enough);
• Request changes to the base structure or linework of a drawing after approving the sketch, except if it regards a discrepancy that's clearly listed in the character's reference sheet;
• Request changes to the coloring after its approval;
• Redistribute and monetize my work without my consent;
• Neglect credit to my work when asked;
• Demand me to emulate other artist's style, or make modifications that stray too far away from my style guidelines;
• Claim authorship or assume they made the art — I retain all copyright and credit for the creation;

WHAT THE CLIENT RECEIVES:
• Artwork delivered in multiple sizes and file formats (PNG, JPG, etc.) according to the agreed request;
• Maximum file size: up to 4k
• Delivery via email or Telegram.

FOR GRAPHIC ART (product promotion, service advertising, banners, logos for campaigns, etc.):
The client may:
• Use the graphic art on digital platforms to promote their product/service;
• Request up to 2 rounds of minor adjustments (colors, fonts, alignment) after final delivery;
• Resize or print the art for internal use (email marketing, handouts);
• Have great success selling with their new graphic art!
The client may not:
• Use the graphic art before full payment;
• Request structural changes (layout, composition, hierarchy) after the concept/sketch is approved;
• Redistribute the graphic art as a template, free resource, or sell the raw file;
• Use the graphic art to sell physical products (t-shirts, mugs, prints, stickers, or any merch) — that requires a separate commercial license and extra fee.;
• Use the art for products/services that violate my "I will not draw" list;
• Demand me to copy another designer's style.
• Claim authorship or assume they made the art — I retain all copyright and credit for the creation;
WHAT THE CLIENT RECEIVES:
• All files used in the project delivered, including editable source files (PSD, AI, CDR, etc.);
• Backup kept for at least 3 years in case the client loses their files — just contact me and I'll resend;
• Delivery via email or Telegram.

CREDIT RULES – IMPORTANT:

Why? Reposting my art without credit reduces visibility to my official art channels. Credit is required when the post is about the art itself. For product/service ads, credit is optional — your sales come first there.

COMMERCIAL LICENSE – PHYSICAL PRODUCTS
This license is an ADD-ON to my standard Terms of Service. It only applies if explicitly agreed upon and paid for before the artwork is created.With this license, the client MAY:
• Print the graphic artwork on physical products (t-shirts, mugs, stickers, posters, phone cases, etc.) for resale;
• Keep 100% of the revenue from sales — no royalties to me.
The client may NOT:
• Sell or redistribute the digital file itself (as a template, download, or asset);
• Sub-license, transfer, or sell this license to a third party;
• Claim copyright ownership of the artwork.
License fee: $ 50 USD (one-time payment)
No limit: infinit units per product type
Duration: Lifetime for the agreed batch 2 years
To extend the duration, contact me for a new agreement.

AS THE ARTIST, I HAVE THE FOLLOWING RIGHTS (for BOTH types):

• To distribute and use the artworks for self-promotion, unless there's a discussion about it before payment.
• To refuse any commission for any reason.
• To set and change my prices at any time, for any reason.
• To add, discontinue, and offer products and services at my discretion.
• To put a commission on hold and start the next one if the client doesn't reply in 48 hours.
• To alter these Terms of Service at any time*, for any reason.
• I am not responsible for how my artwork is used beyond the platforms where I willingly posted them.
• For graphic art: the client receives a non-exclusive, non-transferable license. I keep all copyrights.
Please note that, no matter the alteration, the client holds the right to comply only with the version that they read.

I WILL NOT DRAW (for either type):
• Extreme violence (torture, physical oppression, humiliation, etc);
• Hyper
• Inflation
• Macro / Micro
• Cub
• Scat / Watersports
• Symbols, gestures, actions, situations and texts that tread on racism, sexism, homophobia, transphobia, or any form of hate crime.
PAYMENT
• Payment is in USD/REAL and exclusively through PayPal, KO-FI, or PIX.
• Payment is taken always either upfront, or after my sketch is approved.
REFUNDS
• The customer has up to 7 days, or until I start the paid part of the order (sketch approval), to request a full refund.
• After 7 days, or after the sketch has been approved and I have started your order, I can offer a 50% refund.
• If the order has been completed, no refunds will be issued.


Terms of Service for Discord Mannager

ABOUT THE SERVICE:The client may:
• Request server setup and configuration using Discord’s existing tools and bots;
• Share ideas, references, and examples of how they want their server organized;
• Request custom commands when possible, using existing bot features;
• Ask questions and request clarification during the configuration process;
• Remove my administrative role after the configuration is completed.
The client may not:
• Request the service without proper authorization from the server owner;
• Request configurations that violate Discord’s Terms of Service or Community Guidelines;
• Demand work before payment is completed;
• Hold me responsible for changes made by other administrators after the configuration is finished;
• Use the service to create systems intended for harassment, abuse, or harmful activity.
As the service provider, I have the following rights:
• To perform the configuration personally using Discord’s native tools and authorized bots;
• To create custom commands when possible using existing bot systems;
• To refuse any service request for any reason;
• To pause or stop the service if the client becomes unresponsive for more than 48 hours;
• To refuse configurations that violate Discord’s policies;
• To update these Terms of Service when necessary.
Privacy & AccessTo complete the configuration, I will need a trusted role with administrative permissions or equivalent access.• This access will only be used for server configuration;
• I will not share, distribute, or use any private server information;
• All server data, conversations, and internal structures will remain confidential.
Payment• Payment must be completed before the service begins.
• Payment methods accepted: PIX or Ko-fi.
• If paying via PIX, a payment confirmation receipt is required.
• Ko-fi payments are processed in USD, and the final price may vary due to currency conversion or platform fees.
Service ScopeThis service focuses on Discord server configuration, which may include:• Channel and category organization
• Role and permission setup
• Bot installation and configuration
• Custom commands using existing bot command systems
• Server structure and automation setup
This service does not include:• Custom bot development
• Staff work or server moderation
• Long-term administration or community management
Responsibility for the service is limited to the proper configuration and functioning of Discord systems and features at the time of delivery.Refunds & Cancellation• If the service has not started yet, cancellation requests may be discussed.
• Once the configuration process has started, refunds are not available due to the time and work already invested.
Final NoteBy requesting this service, the client confirms that they:• Are the server owner or have permission from the owner
• Authorize the access required to configure the server
• Agree to these Terms of Service
• Understand that the service begins only after payment confirmation
